Opinion forum: do we have our inheritance ready?

Rafael Vallet, partner of the family law area, publishes in Expansión an opinion article in which he poses this question: Do we have our inheritance prepared? Our lawyer reflects on the case of the plane crash portrayed in the movie The Snow Society: "What would happen if one day I do not return? Do I have everything prepared so that my family does not have any legal problems?"

He also gives us different answers, for example, when a will has been made: "Having a will granted, the so-called intestate succession no longer comes into play, that is, the law cannot designate my heirs", or the difference that exists when the successors are minors, in which case one must "appoint guardians and/or administrator of the assets".

Our lawyer expert in inheritance proceedings also talks about tools such as preventive powers of attorney: "In the event of the undesired incapacity, the attorney-in-fact will be able to manage the estate and the personal and economic interests of the principal, avoiding possible damages"; or the use of the living will, with which "we express our will in advance, with the aim that it will be fulfilled at the time when we are not able to express ourselves personally, for example about the care and treatment of our health or, once death arrives, about the destination we want to give to our body or our organs".

His position, whether as a lawyer or as a father, is clear: to leave the family as few problems as possible when it comes to managing the inheritance. Because one thing is clear and that is: "one of those days we may not come back".
