New jurisprudential precedents: Trademark Protection

Victoria Alonso, a lawyer in the commercial area, analyzes in the new issue of the Perfumery and Cosmetics Sales Magazine, some precedents of jurisprudence generated as a result of the great battle between some brands in the luxury sector and large online sales companies such as Amazon. The article also explains the rights that we have in terms of brand protection - how we must protect our brand and the rights that exist against illicit sales in electronic marketplaces.

As our commercial lawyer notes in her text: "By virtue of the judgment of December 6, 2017 of the Court of Justice of the European Union ("CJEU"), the protection of major brands in the battle against the uncontrolled use of electronic marketplaces was strengthened by affirming the lawfulness of the prohibition that a trademark owner may impose on one of its official distributors to offer the brand's products and sell the same through third-party platforms such as Amazon in the framework of a selective distribution network".
