Digital platforms and social networks have legal responsibility for their users' content, but this must be balanced with the protection of their privacy. This debate has been reignited following Brazil's blocking of social network X.
Adrián Manrique, a lawyer specialising in data protection and digital law, commented on RTVC´s Telenoticias 1 programme on the difficulty of verifying the diligence of these platforms: ‘The issue is to verify that the mechanisms they have in place to try to tackle these potential threats or inappropriate content are efficient.’
The Digital Services Act (DSA), which came into force last February, gave digital platforms responsibility for their users' content. The measure was intended to bring greater transparency and security to the digital environment. However, in practice, it depends on whether those responsible for these platforms are willing to cooperate when fraudulent or inappropriate content is investigated.
