According to recital 30 GRDP, natural persons may be associated with online identifiers provided by their devices, applications, tools and protocols, such as internet protocol addresses, cookie identifiers or other identifiers, such as radio frequency identification tags. This may leave traces which, in particular when combined with unique identifiers and other information received by the servers, may be used to create profiles of the natural persons and identify them. Thus, CECA MAGÁN has implemented a cookie policy in observance of applicable regulations.

1. Applicable regulations:

According to article 22 of Spanish Law 34/2002 of 11 July on Information Society Services and E-Commerce (LSSICE) regarding the rights of recipients of online commercial communications, service suppliers shall solely use data storage and recovery mechanisms in the recipient’s device provided such recipient has given his or her prior informed consent.

Thus, recipients and end users shall be provided clear and accurate information on the use and, specifically, on the purpose of the data processing, according to the provisions of the regulations protecting personal data. Therefore, when technically possible and efficient, the recipient’s acceptance of the data processing may occur by means of the appropriate browser or other application parameters.

The foregoing shall not prevent any potential technical storage or access for the sole purpose of transmitting a communication using an online communication network or, if strictly necessary, for the provision of a service expressly requested by the recipient thereof.

2. User consent and cookies: general rule and exception.

As a general rule, if the installation and/or use of (first- or third-party, session or persistent) cookies involves the processing of personal data, CECA MAGÁN, in its capacity as data controller, shall provide the information necessary in this regard and seek the user’s prior informed consent to install and/or use such cookies.

Excepted from such consent are any cookies which solely allow the communication between the user’s computer and the network and strictly those used to render a service requested by the user. For instance, excepted are the so-called “technical cookies” (e.g. those needed to browse the platform or application); “customization and settings cookies” (e.g. those allowing the site to recognize the user’s language, etc.); and “security cookies” (e.g. to detect failed and repeated log in attempts).

3. Are cookies used on the Platform? What are they?

Cookies are used on the Platform, that means files or devices are downloaded into the user’s terminal equipment (personal computer, smartphone, tablet, mobile terminals and devices, etc.), regardless of their nature and one main purpose: guarantee the smooth operation of the Platform (remember the language chosen and similar functions). Thus, generally and notwithstanding the provisions hereunder, cookies allow the user to smoothly browse the Platform and enable some utilities and services contained therein. Therefore, please be advised that disabling or blocking the cookies may affect browsing and the proper or complete use of the Platform.

4. What cookies do we use on the Platform?

There are first- and third-party cookies. First-party cookies are sent to the user’s terminal equipment from the Platform (editor) and are managed by it, whereas third-party cookies are those sent to the user’s terminal equipment from domains or equipment which are not managed by the Platform (editor), but by another entity processing the data obtained through the cookies.

Moreover, there are session and persistent cookies. The former are cookies designed to collect and store data while the user accesses the Platform in order to store information which is only relevant to render the service requested by the user once. However, thanks to the latter data are stored in the user’s terminal equipment and may be accessed and processed for a limited period of time by cookie manager.

Cookies may also be technical if they allow the user to browse the Platform and use the different options or services made available on it —e.g. Control data traffic and communication, identify the session, access restricted-access parts of the site, remember the elements included in a contractual request, use security measures during browsing, store contents for the dissemination of video, audio or share contents using social media.

Cookies may also be customization cookies, which allow the user to access the service with some predefined features depending on some criteria linked to the user’s terminal equipment —e.g. the browser used to access the service, the regional settings, etc.

Likewise, cookies may be intended for statistical or informative purposes for the editor to ascertain how the users use its Platform or the contents or services made available on it.
